Lawyer Overview

Steve Foresta is currently serving as head of the Litigation Department for the New York office. He has extensive experience in matters involving a broad range of substantive areas of the law, with a primary focus on representing pharmaceutical, medical device and chemical companies in mass tort and products liability actions, environmental litigation and insurance coverage disputes. In addition, Mr. Foresta has handled general commercial disputes, patent infringement claims and other matters for clients in a wide variety of industries.

His principal current responsibilities include:

  • Counsel for major pharmaceutical company on all insurance coverage matters relating to mass torts, including several disputes with foreign and domestic insurers that are the subject of ongoing civil litigation and arbitrations.
  • Lead member of team defending over-the-counter drug manufacturer in New York state and federal court actions involving alleged personal injuries resulting from the use of cough and cold medications containing phenylpropanolamine (PPA).
  • Representation of computer parts manufacturer in breach of contract dispute with a wholesale distributor arising from the failed launch of a line of NASCAR-themed computer products.
  • Lead counsel for consumer products manufacturer in personal injury cases arising out of exposure to asbestos-containing products.
  • Coverage counsel for real estate investment firm, medical device manufacturer, consumer products distributor and Big Four accounting firm providing advice in connection with insurance disputes involving alleged product liability, premises liability, environmental liability, accountants’ liability and patent infringement.

Among the more significant past engagements in which Mr. Foresta has been involved are the following:

  • Representation of American Home Products Corporation as partner-in-charge of a complex declaratory judgment action to determine AHP’s right to insurance coverage for liability imposed against the company as a result of environmental contamination at dozens of sites located across the United States.
  • Representation of Union Carbide Company as part of team coordinating national defense of over 80,000 claims involving alleged personal injury resulting from exposure to asbestos and asbestos-containing products.
  • Trial counsel for Ekco Housewares Company in multiparty CERCLA cost-recovery action raising novel issues of successor liability and compliance with National Contingency Plan.
  • Served as lead member of team involved in defense of the Wyeth-Ayerst division of American Home Products Corporation in nearly 150 products liability actions brought in state and federal court in New York involving the Norplant® System, an implantable long-term hormonal contraceptive product.
  • Participation as an associate and partner on a team representing American Cyanamid Company as national counsel in products liability litigation involving childhood vaccines.
  • Representation of intraocular lens manufacturer in a series of patent infringement actions brought by an inventor and licensees of competing products.
  • Defense of U.S. subsidiary of a Chinese trading company indicted and tried in the Southern District of New York for allegedly importing textiles in violation of Customs laws.

Before joining Orrick, Mr. Foresta was a partner in the litigation department of Donovan Leisure Newton & Irvine.
