Lawyer Overview

Dennis Murphy is a trial lawyer with experience in a broad range of product liability, complex commercial, and employment litigation. He has tried cases for some of Jones Day's most important clients and has been lead counsel in multiple cases in state and federal courts throughout the country. Dennis has significant experience in defending class actions, claims by individuals for personal injury, and in coordinating complex litigation.

Some of his recent activities on behalf of Firm clients include:

• As trial counsel, helped secure a unanimous defense verdict on all claims for the R.J. Reynolds Tobacco Company in a smoking and health case that proceeded in federal court in Washington. The plaintiff sought $10 million in damages. The case was tried in May 2006.

• Obtained two preliminary injunctions for Zimmer, Inc. The first, obtained in federal court in Ohio, forced the defendant to honor a supply contract, enabling Zimmer to continue a multimillion dollar line of business. The second, obtained in Michigan state court, stopped a competitor's raid of a Zimmer distributor's sales force. Both cases were eventually settled on favorable terms for our client, the Michigan case after a week of trial on the merits in December 2006.

• Helped Nextel Communications, Inc. defeat an arbitration brought by Nextel Partners to enjoin changes to Nextel's brand following the merger of Nextel and Sprint, and to block Sprint Nextel's multimillion dollar roll out of the combined company's new brand.

• Successfully represented Nextel in a series of cases brought by so-called "Sprint Affiliates" to attempt to enjoin Nextel's merger with Sprint.

• Helped defend The Sherwin-Williams Company in ongoing public nuisance cases brought against it and other former lead pigment manufacturers by several Ohio cities.

• Continued to represent R.J. Reynolds in smoking and health lawsuits filed against it in Louisiana. Recent successes have included an appellate affirmance of the dismissal of punitive damages and other claims, affirmance by the Fifth Circuit of a denial of remand in a class action claiming consumer fraud regarding Reynolds "light" cigarettes, and a summary judgment dismissal of all claims, after argument, in a case pending in federal court in New Orleans.

Along with these recent achievements, for more than 10 years Dennis has been a part of the Jones Day team representing R.J. Reynolds Tobacco Company in actions filed against Reynolds nationwide. He has coordinated litigation and represented Reynolds in cases brought in Ohio, Louisiana, California, New York, Iowa, and Washington. Dennis has experience in every phase of litigation and has been a part of the trial teams for several trials against Reynolds. Dennis also has served as national coordinating counsel for a medical products company.

Dennis serves on Jones Day's Firmwide Lawyer Training Committee and regularly conducts training seminars for groups of lawyers. He is a member of the Cleveland Bar Association. He is coauthor (with Mark Belasic) of the Ohio chapter in Tort Law Desk Reference — A Fifty State Compendium (Aspen). For the last several years, he has been named an Ohio Super Lawyer.
